The terms that govern your use of Homie.

Welcome to Homie ("Homie," "we," "us," or "our"), an AI-powered housing matchmaker and superconnector accessible via askhomie.ai (the "Service").

By accessing or using our Service, interacting with Homie via web chat, SMS, email, or any other messaging interface, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Service.

1. Acceptance of Terms

By using Homie, you confirm that:

  • You are at least 18 years of age (or the age of legal majority in your jurisdiction).
  • You have the legal capacity to enter into a binding agreement.
  • You agree to comply with all applicable local, state, national, and international laws and regulations.

2. Description of the Service

Homie is an AI-powered housing connector and matchmaker. We help seekers discover housing options (sublets, rooms, private apartments, and coliving) and facilitate introductions between seekers, hosts, property owners, and community members.

Homie aggregates and references listings from both public online platforms and private community networks (such as verified social media groups, messaging channels, and direct host submissions).

3. Real Estate Broker & Licensing Disclaimer

HOMIE IS NOT A LICENSED REAL ESTATE BROKER, REAL ESTATE AGENT, PROPERTY MANAGER, ESCROW HOLDER, OR LANDLORD.

  • No Professional Advice: Homie does not provide legal, real estate, financial, or tax advice. Any information provided through the Service is for informational and introductory purposes only.
  • No Verification of Listings: While Homie strives to share relevant opportunities, we do not independently inspect, verify, survey, or warrant the condition, safety, legality, pricing, square footage, amenities, availability, or host ownership of any property or listing surfaced.
  • Not a Party to Agreements: Homie is never a party to any rental agreement, lease, sublease, license, or financial transaction between seekers and hosts. We do not collect, hold, or arbitrate security deposits, upfront fees, or rent payments.
  • Your Responsibility: You are solely responsible for conducting your own thorough due diligence, including in-person or live video tours, verifying host identity and ownership, and reviewing all lease terms before signing documents or transferring any funds. Never wire funds or pay a deposit before verifying a listing and host in person or through confirmed identity checks.

4. Equal Housing Opportunity & Fair Housing Act

Homie fully supports and complies with the federal Fair Housing Act (42 U.S.C. 3601 et seq.), Title VIII of the Civil Rights Act, the California Fair Employment and Housing Act (FEHA), and all applicable state and municipal fair housing regulations.

We do not knowingly publish, facilitate, or tolerate listings, searches, or communications that express any preference, limitation, or discrimination based on:

  • Race, color, or ethnicity
  • Religion or creed
  • Sex, gender identity, or gender expression
  • Sexual orientation
  • National origin or ancestry
  • Familial status (including families with children or pregnant individuals)
  • Physical or mental disability
  • Marital status
  • Source of income (including housing assistance vouchers)
  • Age, veteran status, or any other characteristic protected by law

Users may not submit housing requests or listing criteria that violate Fair Housing laws. We reserve the right to immediately terminate access for any user who violates these principles.

5. Paid Services, Subscriptions & Refunds

Homie provides both free access and optional paid premium services.

A. Free Matching Tier

  • Basic housing matching, automated alerts digest, and DIY host links are available at no charge ($0).
  • Matches on the free tier are provided without guarantee of placement or timeline.

B. Homie Alerts ($29/month)

  • Service: Real-time SMS alerts delivered immediately when high-fit listings and off-market drops matching your criteria are detected.
  • Subscription & Recurring Billing: Homie Alerts is billed as an ongoing monthly subscription ($29/month). Your subscription automatically renews each month on your billing date unless canceled prior to renewal.
  • Cancellation: You may cancel your subscription at any time through the customer billing portal link in your receipt or by emailing billing@askhomie.ai. Cancellation takes effect at the end of the current paid billing cycle.

C. Homie Concierge ($99 Flat Fee)

  • Service: Dedicated, white-glove assistance including priority candidate matching, direct host outreach on your behalf, viewing and tour coordination, private community access coordination, and scam red-flag checks.
  • Payment: Billed as a single, one-time flat service fee of $99.
  • 100% Money-Back Guarantee: If Homie Concierge is unable to present qualified, criteria-matching housing candidates or coordinate an introduction/viewing within your active search window prior to your target move-in date, you are entitled to a 100% full refund upon written request. Once an introduction is accepted or you sign an agreement for a surfaced property, the Concierge fee is fully earned and non-refundable.

D. Payment Processing

All payments are processed securely via our third-party payment processor, Stripe. We do not store your complete credit card numbers or banking credentials on our servers. By purchasing a paid service, you agree to Stripe's terms of service and privacy policy.

6. SMS Messaging & TCPA / Carrier Disclosures

By providing your mobile phone number to Homie (via web chat, form signup, or direct text), you provide your express written consent to receive recurring automated informational, matching, and service-related SMS text messages from Homie.

  • Purpose of Messages: Housing match alerts, criteria confirmation, viewing logistics, concierge updates, and onboarding support.
  • Message Frequency: Message frequency varies based on your housing criteria, market inventory, and search activity. During an active search, you may receive between 1 and 10 messages per day.
  • Message and Data Rates: Message and data rates may apply depending on your mobile carrier and wireless plan.
  • How to Opt-Out: You can cancel SMS notifications at any time by texting STOP to any message you receive from us. You will receive a single confirmation message confirming your opt-out.
  • Customer Support via SMS: Text HELP to any message for assistance, or contact us directly at support@askhomie.ai.
  • Carrier Disclaimer: Wireless carriers (including but not limited to AT&T, T-Mobile, Verizon, and regional carriers) are not liable for delayed or undelivered messages.

7. Listings and User Conduct

You agree not to use the Service to:

  • Post or transmit inaccurate, fraudulent, deceptive, or misleading listing information.
  • Impersonate any person, host, landlord, or entity.
  • Scrape, harvest, crawl, or systematically extract data or listing information from our Service without express written consent.
  • Harass, abuse, stalk, or send unsolicited spam to hosts, seekers, or other users.
  • Solicit illegal sub-tenancies or assist in violating property leases, condominium bylaws, or local zoning/short-term rental ordinances.

Homie reserves the right, in its sole discretion, to remove any listing or suspend/terminate any user account or phone number at any time for violation of these Terms.

8. Third-Party Platforms, AI & External Links

  • External Sources: Homie surfaces links to third-party platforms (e.g., Craigslist, Furnished Finder, Facebook Groups, WhatsApp communities, partner coliving providers). We do not control and are not responsible for the content, privacy practices, terms, or availability of third-party platforms.
  • Private Community Groups: Certain listings may require you to join or be approved by third-party private groups (e.g., Facebook groups). Homie cannot guarantee group admission or host response times.
  • AI-Powered Outputs: Homie uses advanced artificial intelligence models and automated agents to parse housing requests and summarize listings. While we continually tune for precision, AI-generated descriptions may occasionally contain inaccuracies. Always verify listing facts directly on the source post.

9. Intellectual Property

The askhomie.ai website, Homie brand, logo, mascot art, underlying software, workflows, and curated database are the exclusive intellectual property of Homie and its licensors. You are granted a personal, limited, non-transferable, revocable license to access and use the Service strictly for personal housing discovery.

10. DMCA / Copyright Infringement

If you believe that any content or listing link displayed on Homie infringes upon your copyright, please notify our Designated Copyright Agent at legal@askhomie.ai with:

  1. Identification of the copyrighted work claimed to be infringed.
  2. The specific URL or listing details claimed to be infringing.
  3. Your contact information (name, address, telephone number, and email).
  4. A statement of good faith belief that the disputed use is unauthorized.
  5. A statement made under penalty of perjury that the notification is accurate and you are authorized to act on behalf of the owner.

11. Disclaimers & Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
  • HOMIE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, ERROR-FREE, OR SECURE, OR THAT ANY LISTINGS SURFACED WILL RESULT IN A SUCCESSFUL TENANCY.
  • IN NO EVENT SHALL HOMIE, ITS FOUNDERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING DAMAGES FOR LOSS OF RENT, LEASE TERMINATION, HOUSING DISPLACEMENT, DAMAGE TO PROPERTY, FRAUD BY THIRD-PARTY HOSTS, OR LOSS OF DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
  • OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO HOMIE IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

12. Indemnification

You agree to indemnify, defend, and hold harmless Homie and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal and accounting fees) arising out of or in any way connected with:

  • Your access to or use of the Service.
  • Your violation of these Terms or Fair Housing laws.
  • Your interactions, rental agreements, lease negotiations, or disputes with any host, seeker, or third party encountered through Homie.

13. Dispute Resolution, Binding Arbitration & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

  • Informal Resolution: Before initiating formal legal proceedings, you and Homie agree to attempt to resolve any dispute, claim, or controversy informally by contacting support@askhomie.ai.
  • Binding Arbitration: If the dispute is not resolved within thirty (30) days, any controversy or claim arising out of or relating to these Terms or the Service shall be settled by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
  • Class Action Waiver: YOU AND HOMIE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
  • Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.

14. Modifications to Terms

We reserve the right to revise or update these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. Continued use of the Service after any changes constitutes your acceptance of the new Terms.
