The terms that govern your use of Homie.

These Terms of Service ("Terms") govern your use of Homie, an AI superconnector designed to help you find housing matches in San Francisco. By sharing your contact information and using Homie, you agree to these Terms.

Definitions

  • "Service": The Homie platform and its functionalities, including the AI chat, housing match suggestions, and text/email introductions.
  • "User": An individual who shares their name, email address, and phone number with Homie through the chat interface and agrees to these Terms.
  • "Match": A housing opportunity, listing, or potential roommate connection that Homie surfaces based on the information you provide.
  • "Personal Data": Any information relating to an identified or identifiable natural person, as defined by the General Data Protection Regulation (GDPR).
  • "Data Controller": Homie, as the entity that determines the purposes and means of processing personal data.

Eligibility

You must be at least 18 years of age to use the Service. By using Homie, you represent and warrant that you are at least 18 years old. If you are under 18 years of age, you may not use or access the Service under any circumstances. Homie reserves the right to request proof of age from any user and to terminate or suspend access for users who are found to be under 18 years of age.

Registration and Service Access

The registration process for Homie occurs through our chat interface:

  • You start a conversation with Homie and share what you are looking for.
  • Homie asks for details such as your budget, preferred neighborhoods, move-in dates, and a bit about yourself.
  • To receive matches, you provide your full name, email address, and phone number, and agree to these Terms and our Privacy Policy.

You are not considered a User of the Service, and these Terms do not take effect, until you provide your contact information and confirm your agreement. Prior to that step, no matching or introduction services will be provided.

Marketing Communications Opt-In

By providing your email address and phone number, you consent to receive marketing emails and SMS text messages from Homie. These messages may include updates about new features, events, partnership opportunities, or personalized housing recommendations. You can opt out at any time by using the unsubscribe link in emails or replying with STOP to text messages.

Data Protection and GDPR Compliance

Legal Basis for Processing

Homie processes your personal data under the following legal bases:

  • Consent (Article 6(1)(a) GDPR): Marketing communications (email and SMS), sharing contact information with matches, and newsletter subscriptions.
  • Contract Performance (Article 6(1)(b) GDPR): Processing necessary to provide housing match suggestions and deliver introductions.
  • Legitimate Interests (Article 6(1)(f) GDPR): Service improvement and analytics, platform security and abuse prevention, and customer support.
  • Legal Obligation (Article 6(1)(c) GDPR): Compliance with applicable laws and regulations.

Your Data Protection Rights

Under GDPR, you have the following rights:

  • Right of Access (Article 15): Request information about what personal data we process and obtain a copy.
  • Right of Rectification (Article 16): Request correction of inaccurate personal data.
  • Right of Erasure (Article 17): Request deletion of your personal data in certain circumstances.

  • Profile and matching data: Retained while your account is active and for 2 years after account deletion.
  • Communication records: Retained for 3 years for service improvement and support.
  • Marketing data: Retained until you opt out, then deleted within 30 days.
  • Legal compliance data: Retained as required by applicable law.

Consent Withdrawal

You may withdraw your consent at any time by:

Withdrawal of consent does not affect the lawfulness of processing based on consent before withdrawal.

Data Breach Notification

In the event of a personal data breach that poses a high risk to your rights and freedoms, we will notify you without undue delay and provide information about:

  • The nature of the breach.
  • Likely consequences.
  • Measures taken or proposed to address the breach.

User Conduct

Users are expected to maintain respectful behavior when interacting with Homie and any housing contacts introduced through the Service. Inappropriate conduct includes, but is not limited to:

  • Using offensive, discriminatory, or inflammatory language.
  • Engaging in hostile or aggressive communication.
  • Making inappropriate personal remarks or threats.
  • Deliberately attempting to manipulate or misuse the AI system.
  • Any form of harassment or bullying.
  • Posting or sharing fraudulent housing listings.

Violation of these conduct guidelines may result in restriction or removal from the Homie network, at Homie's sole discretion.

Privacy and Data Protection

Homie implements strict data protection measures:

  • Contact information sharing: Your name, email address, and phone number may be shared with potential matches or listing providers when you request introductions.
  • Chat data: Your conversation with Homie is stored and used to generate match suggestions.
  • Data protection: All user data is protected and handled in accordance with Homie's Privacy Policy.

Internal Data Access and Usage

The Homie team has access to and monitors:

  • User conversations with Homie.
  • Email and SMS communications.
  • User behavioral data.

This access is strictly for the purposes of:

  • Monitoring and preventing platform abuse.
  • Improving the product experience.
  • Resolving user issues and concerns.
  • Ensuring service quality and safety.

Specific user information is never exported or used for purposes other than those listed above. Anonymous and aggregated data may be used for product analytics and service enhancement. All team members are bound by confidentiality requirements regarding user data.

Third-Party AI Processing

To provide our services, Homie uses industry-leading artificial intelligence providers. By using the Service, you acknowledge and agree that your communications and interactions with Homie may be processed by third-party AI services, including the Lovable AI Gateway. Information processed by these services may include:

  • Content of your conversations with Homie.
  • Housing preferences and personal context you provide.
  • Contact information you provide for match delivery.

These third-party providers process data according to their own privacy policies and security standards. We select providers based on their security practices and reliability, and we regularly review their compliance with applicable data protection standards.

Service Operation and Matching Process

By using the Service, you understand and agree that:

  • Homie is currently live in San Francisco and surfaces housing matches based on the information you provide.
  • Matches may include listings from WhatsApp groups, Facebook groups, Reddit, Craigslist, and other public listing sources.
  • Listings are not verified. Homie is a superconnector, not a broker or property manager. We do not guarantee the accuracy, availability, or legitimacy of any listing.
  • Do your own due diligence. You are solely responsible for verifying any housing opportunity before entering into an agreement or making a payment.
  • Never send a deposit before you have seen the place and know who you are dealing with.

Safety and Well-being Measures

Homie takes the safety and well-being of its users seriously. The platform is not designed for nor should be used as a substitute for professional advice, including legal or financial services. If at any time you feel that a conversation with Homie or a housing contact is inappropriate or raises concerns, discontinue the conversation and contact our support team for assistance.

Feedback

Homie values user feedback to improve its services. By providing feedback, you grant Homie a worldwide, royalty-free, perpetual, irrevocable license to use, modify, and incorporate your feedback into our services without restriction.

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Homie and its licensors. You agree not to copy, modify, or distribute any part of the Service without prior written consent.

Payment and Fees

Homie is currently free to use. You are responsible for any charges from your phone service provider related to calls or messages you receive. If Homie introduces any service fees in the future, users will be notified in advance, and continued use of the service after the notification period will indicate acceptance of the new fee structure.

Limitation of Liability

Homie is not liable for any outcomes resulting from housing matches, introductions, or interactions facilitated by the Service. Users agree that the connections facilitated by Homie are done on an "as-is" basis, and Homie does not guarantee the accuracy, availability, safety, or success of any housing opportunity.

To the maximum extent permitted by law, Homie shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of its services.

"AS IS" and "AS AVAILABLE" Disclaimer

Homie's services are provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, either expressed or implied, about the operation of the service, its availability, the accuracy of any listings, or its ability to meet your expectations.

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, except where GDPR or other EU data protection laws apply. Any disputes arising under these Terms will be subject to the jurisdiction of Delaware courts, except for data protection matters which may be subject to EU jurisdiction.

Changes to the Terms

Homie may update these Terms from time to time. Any material changes will be communicated to users via email or platform notifications at least 30 days before they take effect. For changes affecting data processing under GDPR, we may require renewed consent where legally required. Continued use of the service after changes have been made will constitute acceptance of the revised Terms.
